Here are some common questions about appealing visa decisions

Most visas allow for an appeal process. Generally, you can see if you have a right to appeal the decision on your decision letter.

Most appeal applications cost $3727 AUD. We can lessen this in some circumstances.

The ART is the Administrative Reviews Tribunal.

It oversees reviewable migration decisions, and aims to provide a more informal setting to examine the situation compared to a court.

Most visa cases are heard in the General Division.

No, the first step is to apply to the Administrative Review Tribunal (ART). This is much less formal than court, and you are often invited to talk more than the migration agent in this setting.

If the outcome you desire is not reached in the ART, it can then be escalated to Commonwealth Courts, such as the Federal Circuit and Family Court. This requires an immigration lawyer for representation.

Most reviewable decisions have 28 days to apply to the ART. There is no extension available for this.

Most hearings are conducted via phone or streaming.

If you attend in person, it will be in the nearest capital city.

The best location is to check the ART's website.

Current processing times are approximately 1 to 2 years.
